TSB is no longer just a balance. It's a tax gateway.

SMSFDivision 296total super balance

The ATO's two new draft rulings, TR 2026/D3 and LCR 2026/D6, deal with the new total superannuation balance rules from 30 June 2026. They're about much more than Division 296.

TSB is now a critical gateway number across super. It can affect Division 296 tax, carry-forward concessional contributions, non-concessional contributions, co-contributions, the work-test exemption, spouse contribution offsets and, for SMSFs, the segregated method for exempt current pension income.

For most SMSF members it stays fairly simple: an accumulation or account-based pension interest is generally valued at its withdrawal benefit.

The complexity sits mainly with defined benefit interests and certain specialised income streams, where the rules can use Family Law values, actuarial alternative valuation methods and the vested benefits method. SMSFs are overwhelmingly account-based, so keep the Family Law point in perspective. But it's worth watching: SMSF lifetime and life expectancy pensions can have a Family Law value. Through the regulations, government has shown it will import valuation methods from outside the tax system, and TSB is becoming a bigger policy tool.

For the wider policy picture, see my piece on why wealth taxes are coming to Australia.

The more immediate SMSF issues:

  • LRBAs. Where the lender is an associate, or a member has met a condition of release, the member's share of the outstanding loan can be added to their TSB. This add-back doesn't apply for Division 296.
  • Reversionary pensions. These can enter the recipient's TSB just after death, even though the transfer balance credit generally arises 12 months later.

Finally, the drafts were released in November but propose to apply from 30 June 2026, and submissions close 18 December. Funds need clarity quickly.

The message for SMSF advisers is simple: TSB is no longer just a balance. It has become a tax gateway, and getting the valuation and timing right matters.
